a) As regards the proposed closed pipe drainage system the Board considers that the proposed application is viewed positively by the Board and the Superintendent of Public Health is giving his exemption for the installation of this closed gravity soil stack system at the proposed hotel. This exemption is being given under the provisions of the Code of Police Law, Article 97(1)(h)(ii). It has been granted following the technical submissions, the particular merits of this case and subject to the conditions indicated hereunder to which applicant must ensure strict compliance. However, this does not mean that such a system has been approved for all other proposed applications. Each request for the installation of such a system has to be considered by the Superintendent of Public Health on its own merits.

The Board approves the request subject to the following conditions:-
i) all connections have to be located at a level which is accessible at each floor level for maintenance purposes; and
ii) an independent engineer shall be appointed and nominated by the applicant for MEPA’s approval who shall oversee and certify the proposed installation and who will be co-ordinating the necessary report to MEPA.

The Board is recommending that these conditions are specially included in the permit issued by MEPA;
b) With regards to sanitary regulations, the revised layouts of the 29th November 2014 are a significant improvement on the former set of drawings. However, the Board requests that the Engineer’s report is further updated to cater for these latest revised set of drawings;
c) The Board considered the proposed mechanical ventilation acceptable to all the wet areas. Consequently the Engineer’s report needs to be further updated to reflect the latest version of the drawings re the wet areas and is to include all safety issues applicable for good design and functioning of all proposed areas, wet or otherwise;
d) The Board considered the proposed artificial lighting for all wet areas as acceptable. Consequently the Engineer’s report needs to be further updated to reflect the latest version of the drawings for the wet areas and is to include all other possible safety issues for all proposed areas, wet or otherwise;
e) The Board noted that the proposed location of the cesspit needs to be relocated such that it is located sufficiently close to an externally exposed area, which is easily and readily accessible from the road;
f) The setbacks at the upper levels are to be compliant with sanitary regulations. Given that the opposite block covered by planning application PA 3511/14 belongs to same applicant of development covered by this planning application PA 3510/14, the GSB considers compensatory setback: the setback, or lack of it, of one development will make good for the other development and vice versa.

T
he Board after considering all the written and oral submissions by all the parties concerned and after discussing the project in detail and hearing the arguments raised by the PSEO and by the applicant’s architect was in favour in principle of this research project. However, its main concern was the issue of provision of natural lighting and natural ventilation in view of the fact that the complex would be inhabited with staff, students and visitors, even though the project was a pilot project and an experiment to obtain data and mathematical modelling for future projects which was very important for the country as a whole. In this respect the Board considered highly important that the complex would have adequate lighting and ventilation for sanitary purposes fully in accordance with international standards. It was important to note that the proposed project was an experiment and a case study and thus it was stressed that this should not be considered as a precedent to other projects but this was the way forward for the development of possible future guidelines and studies which could be presented for use in other future projects. In reiteration, it is to be stressed that the Board’s decision in respect of this project shall be made sui generis, that means on its own merits ONLY. The Board, after considering the whole project and the concerns raised above regarding lighting and ventilation with respect to the inhabitants of the building was in favour of the project, however, insists that prior to the actual commencement of works an engineer’s report had to be fully endorsed and approved and which must eventually be submitted, approved and endorsed by the PSEO.
The Board conditionally approves this laudable proposal as long as the sanitary issues raised have to be fully addressed, prior to the commencement of works.

He stated that he is proposing that the circulating space will be partitioned such that the said area will be converted into a boxroom and corridor.
The PSEO stated that the height of the premises is not that stipulated by the legislation. He further commented that the size of the circulating space is too big to be considered as such. He further stated that should there be the construction of the boxroom there would be no objection from the part of the Sanitary Engineering Office.
Having taken the above into consideration the Board approves the proposed plans with the construction of the boxroom and considers the height of the said premises to be acceptable.

Perit Camilleri explained that this is an old building with a central courtyard in which a development consisting of two further floors is being proposed. He stated that MEPA is requesting the construction of a 10 ft backyard for the proposed two new additional floors. He further added that the size of the internal yard is adequate to provide lighting and ventilation to the surrounding rooms. Moreover, he stated that he will be submitting fresh plans indicating a setback of 1.35 m at intermediate and third floor levels.
The PSEO stated that in terms of sanitary regulations there should be a backyard as requested by law.
Having taken the above into consideration and given that the property is a very old traditional townhouse located in Valletta, with the size of the existing courtyard sufficient to provide lighting and ventilation to the premises, the Board approves the plans subject to setback of 1.35 m at intermediate and third floor levels and the removal of the balconies that overlook said courtyard at all levels.

Perit Bianchi stated that the size of the internal yard adjacent to the main bedrooms is only minimally less than that required by sanitary regulations. He stated that this was due to having heavy plastering that was required due to irregularity in the existing walls.
The PSEO stated that apart from the internal yard being referred to by Perit Bianchi being less than that required by sanitary regulations there is also the issue of the bedrooms that face the other internal yard. There is a balcony at penthouse level that is also roofed over.
Having taken the above into consideration, the Board decides that the size of the internal yard adjacent to the main bedrooms is acceptable in view of the fact that it is only minimally smaller in width than that required by sanitary regulations but is compensated for by the length of the yard. With respect to the balcony at penthouse level located near the ensuite the Board decides that this structure has to be removed (floor and ceiling). The plans as submitted are therefore approved subject to the alterations mentioned by the Board being implemented.

Perit Camilleri stated that the proposal to cover the courtyard should not impinge on the lighting and ventilation of the other rooms. He pointed out that all bedrooms have external ventilation. He further added that he would be prepared to submit a lighting and ventilation report by an engineer to justify the application.
The PSEO pointed out that his main reservation lies with the kitchen which does not seem to have adequate ventilation with the closure of the courtyard. He also pointed out that the toilet on the ground floor will not have sufficient natural ventilation.
Having taken the above into consideration the Board decides that the plans as submitted can be approved subject to:-
a) removal of partition separating living area and the rear access to kitchen which will enhance ventilation to the kitchen from the backyard;
b) submit a lighting and ventilation report;
c) the ground floor lavatory has to have mechanical ventilation; and
d) the skylight should be automated and retractable and a section drawing of the skylight must be provided to the PSEO and copied to the GSB

Perit Camilleri explained the existing situation whereby the terrace and overlying building is larger than those approved and provide an extension to the adjacent bedrooms. He stated that the backyard is larger than that required by sanitary regulations and therefore the bedrooms in question have both adequate lighting as well as ventilation.
The PSEO contended that the terrace is greater than the 1.5m usually allowed and therefore the lighting and ventilation to the bedroom is not adequate.
Having taken the above into consideration the Board decides that it endorses the plans subject to the removal of the masonry jambs of the doorway leading to the extended area at all levels such that bedroom and the area marked study become one single room. The back wall overlooking the backyard must be totally glazed.

Request for minor amendments to Cottonera Waterfront Hotel

Perit Mintoff claimed that the premises as currently being built are fully in line with the approved permit. He stated that the height of the lift shaft is actually lower than that approved in the permit by 0.3 m. He stated that this aberrant situation came about as a result of the fact that the approved permit was based on a road approximately 4m wide as declared at the time by MEPA. It transpired that in fact the road presently varies from 3.2m to 3.4m wide and therefore the height of the proposed building (12.7m) is in excess of three times the width of the road as stipulated by sanitary regulations.
The PSEO stressed his position that the building as proposed is not in conformity with sanitary regulations.
The Board having taken the circumstances in this particular case into consideration decides to approve the plans as submitted.

After having seen the documents, plans, written submissions and heard the verbal submissions by both parties the Board considers that the proposed internal height in the kitchen area is in itself well below sanitary requirements. However, given that there are no walls separating the kitchen from the living area and given that part of this kitchen has an internal height of 4.0m, the Board considers that natural ventilation requirements are sufficient. The sufficiency of the lighting and ventilation to this area is further confirmed by the submitted engineer’s report.
Taking into consideration that this is an existing building within what can be regarded as a rather small site the Board approves the plans as submitted.

The Board decided that the plans can be approved provided that the façade of the 21.8 sq.m. bedroom at first floor overlooking the alley is to be retracted so that the windows of this bedroom and the 8.0 sq.m. bedroom have a minimum of 3.0m open space in front of their aperture.

The Board approves the proposed railing.
